Welcome to FocuShift. By using the FocuShift app or website, you agree to these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance

By creating an account or using FocuShift, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the service.

2. Description of Service

FocuShift is an app that helps you create personalized affirmation scripts with AI, generate audio with text-to-speech and optional voice cloning, and listen to your content in playlists. The service includes:

  • AI-generated affirmation scripts based on your input
  • Text-to-speech audio generation
  • Optional voice cloning (cloning your voice for personalized audio)
  • Playlist creation and playback
  • Cloud sync of your content across devices
  • Subscription plans with different usage limits

3. Account

You must create an account to use FocuShift. You agree to:

  • Provide accurate information
  • Keep your password secure
  • Notify us of any unauthorized access

You are responsible for all activity under your account.

4. Acceptable Use

You agree not to:

  • Use the service for any illegal purpose or in violation of any laws
  • Create content that is harmful, harassing, defamatory, obscene, or that infringes others' rights
  • Attempt to circumvent usage limits, security measures, or access controls
  • Reverse engineer, decompile, or disassemble the app
  • Use the service to spam, abuse, or harm others
  • Share your account or credentials with others

We may suspend or terminate your account if you violate these Terms.

5. Subscriptions and Payment

FocuShift offers free and paid subscription plans. Paid subscriptions are billed through the Apple App Store. By subscribing:

  • Payment is charged to your Apple ID account
  • Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period
  • You can manage or cancel subscriptions in your device's App Store settings
  • Refunds are handled by Apple; contact Apple Support for refund requests

We may change subscription prices or plan features with notice. Continued use after changes constitutes acceptance.

6. Your Content

You retain ownership of the content you create (scripts, recordings, etc.). By using FocuShift, you grant us a limited license to store, process, and display your content as necessary to provide the service (e.g., generating scripts, creating audio, syncing across devices). We do not use your content for advertising or to train models outside of what is required to operate the service.

7. AI-Generated Content

Scripts are generated by AI (OpenAI) and text-to-speech is provided by ElevenLabs. We do not guarantee the accuracy, quality, or appropriateness of AI-generated content. You are responsible for reviewing and editing content before use. The service is for personal affirmation and self-improvement; it is not a substitute for professional mental health or medical advice.

8. Voice Cloning

If you use voice cloning, you consent to your voice sample being processed by ElevenLabs. You represent that you have the right to use the voice you clone (e.g., your own voice or with permission). You can delete your cloned voice at any time through the app.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOCUSHIFT AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Termination

You may delete your account at any time in Account Settings. We may suspend or terminate your account for violation of these Terms or for any other reason. Upon termination, your right to use the service ends. We will delete your data as described in our Privacy Policy.

12. Changes to Terms

We may modify these Terms from time to time. We will notify you of material changes via the app or email. Continued use after changes constitutes acceptance. If you do not agree to the new Terms, you must stop using the service and delete your account.

13. General

  • Governing law: These Terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles.
  • Entire agreement: These Terms and the Privacy Policy constitute the entire agreement between you and FocuShift.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • Waiver: Our failure to enforce any right does not waive that right.
